JDM Import Cars - Import Quality Japanese Used Cars and Machineries in Australia

1. Before making bid
   Check your country's importation laws and regulations as the client is responsible to be aware of all legal requirements and costs when importing a used vehicle being Japanese or European cars, trucks, motorcycles and any machinery into their chosen country. JDM Import Cars requires you, the buyer, to be fully aware of any requirements in regards to importing cars to your country. Any advice given on the behalf of JDM Import Cars is not liable as rules and regulations can change without any notice. 
    

2. Placing bids at the auction
   Every customer is entitled to select any number of vehicles as long as it is within the allowed limit, based on the customer's deposit amount and JDM Import Cars will place bids on behalf of the customers.
   JDM Import Cars staff will confirm all successful/unsuccessful bids by email or phone within 24-48 hours after the bidding request has been placed.
    

3. The Auction
   Ninja is a system operated by a company that is not affiliated with us. We will not hold responsibility for any cases where we can't bid for a car due to external factors such as technical difficulties.
    

4. After the auction
   For successful bids, the customer will be notified and be sent an invoice indicating the price in either FOB or C&F (cost & freight) fees to meet your market setting.
   All car shipments are done by roll on roll off basis by default, but customers/dealers may choose to ship by container shipment basis depending on the availability of the customer's country/port.
   Customers will be notified within 24-48 hours of any change (increase or decrease) in the total FOB or C&F price.
   In the case of unsuccessful bids, customers will also be notified with some suggestions of similar models that are available for future transactions.
    

5. Payment
   Please note that once a bid is won, the amount of the invoice issued must be paid in full by bank transfer. Payment of one hundred percent (100%) of the FOB or C&F price for each successful bid is required within 24 hours upon the confirmation of the shipping port. 
   The customer will bear the risk of all changes in logistics or increases in delivery costs.
   JDM Import Cars interest and penalty will apply for late payment or non-payme\nt. Late payment will result in a 14.8% penalty. The cancellation fee is $2400 or 15% of the selling price, whichever is a bigger amount.
   The security deposit will be refunded after the payment is received, if requested.

6. Shipment
   After JDM Import Cars has confirmed the required payments and shipping line availability, the vehicle(s) is scheduled for shipment at the earliest possible date. The customer will bear the risk of all changes in logistics or increases in delivery costs.

7. Risk and title 
   All risk of the used vehicle shall be passed on from JDM Import Cars to the buyer at the time when the vehicle or vehicles leave the auction house or our storage facility. Title to the used vehicle shall be conveyed from seller to buyer at the time when the used vehicle or vehicles passes the rail of the ocean-going vessel at the port of loading.
    

8. Edits
   Edits and modifications of the bid request such as changing of the price/budget, change of shipping port and country, and change of inspection/insurance options are only accepted if the vehicle has more than 2 hours remaining before the actual auction schedule. Edits and modifications done after the 2 hour-mark will be deemed invalid and will not be accepted.
    

9. Cancellations
   Auction vehicles are different and not part of the JDM Import Cars stock. This means vehicles at auction are purchased upon the customer's request. Cancellations of bid requests can be applied with no less than 24 hours remaining on the auction schedule.
   Upon cancellation, we reserve the right to resell cancelled units at our re-sale price without the customer's approval.
   Cancellations done after the vehicle has been purchased or has less than 12 hours before the auction starts are subjected to Auction Cancellation Penalty (Please refer below)
    

10. Penalties
    (1) Late Payment Penalty
    JDM Import Cars reserved the right to impose a penalty for late payments. Vehicles that are not paid within the specified timeframe are subjected to a penalty fee of $50 or 3% of the vehicle price, whichever is higher.
    JDM Import Cars also reserves the right to its discretion to return the vehicle to the auction and impose a compensation fee of $1500 or 15% of the total vehicle price, whichever is higher.
    (2) Penalty for Breaking a Contract
    In the event that the customer breaks a contract, JDM Import Cars reserves the right to pursue legal actions and/or impose a fee of $1500 or 15% of the total vehicle price, whichever is higher.
    Acts such as the following but not limited to, will result in a breach of contract:
    ・Failing to pay for the purchased vehicle within 5 workdays
    ・Changing terms, shipping port/country after purchase
    ・Fake account for fake buying-bidding
    ・Cancellation of the purchase after the deal has been concluded
    (3) Penalty for Auction Cancellation
    JDM Import Cars reserves the right to impose a penalty on cancellations done after the vehicle has been purchased or 2 hours before the auction start time as subjected to a penalty fee of $1500 or 15% of the total amount, whichever is higher.
     

11. Account Cancellation
    JDM Import Cars has the right to cancel memberships of any customer that has violated the website's rules, regulations, and terms of use.
    For cancelled accounts with deposits, JDM Import Cars  will refund the deposit to the customer but reserves the right to impose a penalty fee depending on which rules have been violated.

The business location of JDM Import Cars is in Coomera QLD 4209 and this agreement shall be governed by, and interpreted in accordance with, the laws of the State of Queensland.
